Public faith in the land register is not a free pass

You buy a house in Trentino, you are entered in the land register, you are safe. Almost always.

In this region the tavolare (land-register) system applies: registration does not merely make the purchase enforceable against third parties, as transcription does in the rest of Italy. It is constitutive. You become the owner when the entry (intavolazione) is made, and the land register (libro fondiario) enjoys “public faith”.

For buyers this is a precious guarantee: you rely on what the register says, and that reliance is protected. Buying property here is, on paper, safer than elsewhere.

But that protection has a price of admission: good faith.

We usually think good faith fails only in the face of a hidden fact — an unregistered adverse possession, something the buyer could not have seen.

There is, however, a more uncomfortable scenario. Good faith can also fail when everything was on the table — the documents, the will, the shares — and the buyer, or the professional acting on their behalf, simply misread the law. Against a principle already settled by the Joint Divisions of the Italian Supreme Court.

This is not about turning every interpretative mistake into bad faith. It is about recognising that, where a principle is consolidated and specific, the error is no longer “excusable”. And an inexcusable error is incompatible with good faith itself.

There is more: where the transaction is handled by an appointed professional, what that professional knew — or ought to have known — falls upon the person who appointed them. Relying on an expert does not launder a foreseeable error.

So the centre of gravity shifts: no longer “what could the buyer have discovered”, but “what should the buyer have understood”.

The public faith of the land register is a strong guarantee. It is not a free pass.

And you, when you buy — do you ask only whether the papers are in order, or also whether those papers have been read the right way?
